User Rules and Guidelines

General Terms and Conditions

All users of UConsignOnline.com must be 18 years of age.

UConsignOnline.com is a website intended to be a friendly and useful experience where you can sell your unwanted items for pennies. As with any sort of transaction, there are risks involved; consequently, we strongly advise you to read all terms before joining.

Rights To Suspend or Terminate
UConsignOnline.com reserves the right to (AND WILL) suspend or terminate ANY user accounts and/or remove any content which violates any rules, terms or conditions.

If you find a listing that you feel violates any of the general terms and conditions of UConsignOnline.com as stated below or to report harassment from another user, please let us know by contacting us at support@UConsignOnline.com

By creating a user account, users agree that UConsignOnline.com may use its discretion at any time to terminate any listing or use of the service by canceling a user account without notice if (a) the user lists a suspicious or restricted item; (b) we find that the user is not adhering to the general terms and conditions; (c) the user repeatedly violates any of the terms or conditions. In most cases, when a listing is reported as questionable, the user account and all listings will be temporarily suspended while we research the issue. If the issue is found to be in violation of any of the terms and conditions, the account may be terminated. All terminated accounts forfeit credits.

User Conduct
Users are solely responsible for the contents of their actions and listings on UConsignOnline.com.

--Users agree to use UConsignOnline.com for selling/purchasing purposes only.  Users agree not use this website to communicate any illegal, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. Users may not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.

-Users must ensure that selling or buying of items does not violate any applicable laws or regulations. This means users must verify that they are able to sell or buy the relevant item by ensuring they are not prohibited to so by any law, recall or regulation.

-Users may not use copyrighted or trademarked material without the consent of the material's owners. When you post content on UConsignOnline.com, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to exercise the copyright, trademark, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future.

-Users must complete their transactions.   

Buyers: When committing to purchasing an item, users must pay for their purchases within 30 calendar days of their commitment unless they cannot communicate with the seller.

Sellers: When listing an item, users guarantee its availability. Users must deliver items purchased from them unless the buyer fails to meet the posted terms.

*Users who fail to complete a transaction receive a warning; a 7 day account suspension for the second violation; and, account termination for the third violation.

Animals, Living or Deceased
Counterfeit Currency and Stamps
Credit Cards
Drugs & Drug Paraphernalia
Drugs, Describing Drugs or Drug-like Substances
Embargoed Goods and Prohibited Countries
Explosives
Firearms, Weapons and Knives – including replicas
Government and Transit Documents
Government and Transit Uniforms
Government IDs and Licenses
Hazardous Items - examples include fireworks and hazardous chemicals
Human Parts and Remains
Items Encouraging Illegal Activity
Ivory and illegal animal products
Lockpicking devices including ‘Bump’ keys
Mailing Lists and Personal Information
Pesticides
Police-Related Items and Equipment
Postage Meters
Prescription Drugs
Prohibited/Illegal Services
Racially Offensive material
Recalled Items
Stolen Property or Property with Removed Serial Numbers
Surveillance Equipment
Transit and Shipping Related Items - including blueprints, operations manuals, uniforms


Registration
In order to register, users must attest to their age. UConsignOnline.com does not allow minors (under 18) to register. Users who are found to be underage will have their accounts terminated immediately.

General Terms
-UConsignOnline.com is not involved in the actual transaction between buyers and sellers. We simply provide an inexpensive medium for the listing. As a result, we have no control over the quality, safety or legality of the items listed; the accuracy of the listings; the ability of sellers to sell items; or, the ability of buyers to pay for items. We cannot obligate sellers to complete sales nor we can we obligate buyers to complete their purchases of items. To protect honest users, we suspend/terminate accounts for violation of these terms. We request that users report violators immediately.

Laws
These Terms of Service shall be governed by and constructed in accordance with the laws of Florida and the United States and any disputes will be decided only by the courts of Florida and the United States.

Reporting Rules Violations
Please report problems, offensive content, restricted items and policy violations to us at support@UConsignOnline.com

Fees
Fees are deducted from pre-paid credits upon listing. Fees guarantee 6 month listing.

-10¢ Per Listing for ANY item with the exception of Real Estate and Motor Vehicles (Automobiles, Trucks, Boats, Motorcycles, Recreational Vehicles, etc).

-$5.00 Per Listing for any Motor Vehicle (Automobiles, Trucks, Boats, Motorcycles, Recreational Vehicles, etc).

-$10.00 Per Listing for any Real Estate ad.

Fees are charged only when items are listed or relisted. Joining, browsing and making offers is free.

Disclaimers
-UConsignOnline.com shall not be responsible for any items sold; for any items damaged during shipping or during the inspection period; for misrepresentations; and/or, breaches of contract by either buyer and/or seller. UConsignOnline.com shall not be responsible for the cost of procurement of substitute goods, legal actions or any losses resulting from any items or services purchased or obtained from a listing on this site.

-UConsignOnline.com will never have ownership of any item listed on the site. The site does not transfer legal ownership of items from the seller to the buyer. Unless all parties involved agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller.

-UConsignOnline.com cannot guarantee continuous or secure access to our services, and operation of the site may be interfered with by numerous factors outside of our control.

-Accordingly, to the extent legally permitted, UConsignOnline.com excludes all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising out of use of our site and services. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

UConsignOnline.com assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can.

Release
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Privacy
UConsignOnline.com will never sell or rent your personal information to third parties for their marketing purposes. We store and process contact information only on computers located in the United States which are protected by physical as well as technological security devices. Users can access and modify the information at any time.

Indemnity
Users agree to indemnify and hold UConsignOnline.com (and our officers, directors, agents, parent company, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of breach of these terms/conditions, or violations of any law or the rights of a third party.

No Agency
-No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
